What They Are Saying: Ways & Means Legislation Delivers Certainty for the Digital Asset Economy

WASHINGTON, D.C.– America will remain the crypto capital of the world and home to a vibrant digital asset economy under legislation recently approved by the Ways and Means Committee. The Digital Asset Tax Certainty Act (H.R. 10357) – historic tax reforms that received strong bipartisan support from the Committee – modernizes the U.S. tax code to better reflect the unique nature of digital assets, creates more certainty for Americans who own, trade, and use cryptocurrencies and other digital assets, and ensures tax parity with more traditional financial assets. At roughly $2 trillion in size and more than 67 million participants and growing – with one in four crypto owners making less than $75,000 a year – the digital asset economy touches all corners of America and every manner of financial transaction from routine payments at a local restaurant to sophisticated investment vehicles.

The creation of the Digital Asset Tax Certainty Act follows over a year’s worth of work and bipartisan negotiation by Committee members that included a July 2025 Ways and Means Oversight Subcommittee hearing on building a 21st century digital asset tax code as well as a June 2026 full Committee legislative hearing to examine various proposals that were ultimately included in the legislation.

Organizations and entities that recognize the need for tax certainty in America’s digital asset economy are speaking out in support of the Committee’s work to produce greater clarity, parity, and a workable set of tax policies for digital asset users.

Ledger

“H.R. 10357 delivers real, practical tax clarity for the millions of Americans who hold and use digital assets. We are especially pleased to see relief for everyday transactions, including the exception for small network, transaction, and brokerage fees; parity with traditional financial assets, including nonrecognition treatment for digital-asset lending, appraisal parity for charitable donations, and a clear $1.00 redemption-value standard for qualified stablecoins; and a sensible, residence-based sourcing rule for mining and staking income that ends the uncertainty cross- border participants have faced for years. Taken together, these provisions reflect a refreshing level of technical care in bringing the tax code into line with how digital assets actually work.” – Seth Hertlein, VP, Global Head of Policy, Ledger

Securities Industry and Financial Markets Association (SIFMA)

“SIFMA shares your goal of creating much-needed tax rules for investments in digital assets and governing the taxation of digital asset transactions that largely mirror, with the addition of critical definitions and other rules, the tax treatment that has applied to trading of stocks, securities, and commodities. Importantly, digital asset tax legislation should ensure a level playing field for digital assets compared to more traditional investment vehicles…” – Kenneth E. Bentsen, Jr., President & CEO, SIFMA

Fidelity Investments

“Fidelity Investments supports H.R. 10357, the Digital Asset Tax Certainty Act, and commends Chairman Smith and the bipartisan work of the Ways and Means Committee for advancing legislation that would bring much-needed tax certainty to digital assets. By establishing clear rules for taxpayers and reducing barriers to innovation, the bill would support U.S. competitiveness and the continued growth of the digital asset ecosystem.” – Fidelity Investments

Investment Company Institute (ICI)

“Millions of crypto investors have been left without a clear way to fix past due taxes…the Digital Asset Tax Certainty Act, which includes a crypto voluntary disclosure program. Thank you @WaysandMeansGOP for leading.” – Andrew Gordon, Managing Partner, Gordon Law

National Taxpayers Union (NTU)

“Authored by Representative Jason Smith (R-MO), this legislation provides digital asset users with tax certainty, safeguards against abuse, and increases tax compliance. Transactions conducted using blockchain technology may require economically negligible dispositions of digital assets for network validation purposes. This legislation would reduce the recordkeeping burden taxpayers face to track these minuscule transactions by creating a de minimis exemption of $10 for these network fees. This legislation also aligns digital asset taxation with the traditional tax treatment of securities in some areas…Finally, this legislation paves a path for broader tax compliance by implementing a voluntary disclosure program allowing taxpayers to amend prior years’ returns if taxable transactions were not previously reported.” – NTU
